Important Clarifications

Definitions and conditions that avoid misunderstandings and ensure legal clarity.

Can I always cancel an online purchase?

Yes, for distance contracts you have a 14-day right of withdrawal. Exceptions apply to personalized goods, sealed hygiene products, or digital content you have already downloaded. The period begins upon receipt of the goods. You do not need to give a reason, but you bear the return shipping costs if the seller has not informed you otherwise.

When can the landlord increase the rent?

A rent increase is permissible up to the local comparative rent, provided the last increase was at least 15 months ago. The cap limit is 20 percent within three years. For modernizations, 8 percent of the costs may be passed on to the annual rent. You can object to the increase if it constitutes a hardship.

How do I request information about my data?

According to Art. 15 GDPR, you can request a free copy of all stored personal data from any company. The request must be answered within one month. It is best to use an informal letter with your email address and identification. In case of violations, the responsible data protection supervisory authority can help.

What to do in case of incorrect delivery or a defect?

In the event of defects, you are entitled to subsequent fulfillment – either repair or replacement delivery. The seller bears the costs and the risk of transport. The warranty period is two years, with the burden of proof on the seller in the first year. Report the defect in writing and set a 14-day deadline for rectification.

Can my employer read my emails?

Private emails on a work device are generally protected. The employer may only inspect them in case of specific suspicions and after prior notice. Different rules apply for purely professional use. General monitoring without a legal basis is not permitted. If unsure, speak with the works council or a specialist lawyer.
